Parents of handicapped child faced with $340,000 legal bill

Most New Mexicans would agree that the birth of their child is among the most wonderful moments of their lives. Fortunately, the majority of babies in this country are born without any complications. However, even when experienced doctors are in the delivery room, some types of birth injuries cannot be avoided. 

The parents of a handicapped 4-year-old boy, who requires constant care, struggle to cover their son’s medical bills. According to the couple, the boy’s problems originated from his birth. While the mother was in the hospital delivery room, the boy stopped breathing while he was still in the womb. His heart also stopped beating, and doctors were unable to revive him until about 13 minutes later. 

Because the boy’s parents cite this incident as the reason for all of their son’s medical problems, they sued the hospital, hoping to receive compensation to cover their costs. Their case was presented before a jury, which ultimately ruled in favor of the hospital. In addition to the hospital bills they had already been paying, they are now responsible for covering the hospital’s legal expenses, which add up to $340,000. Because the boy’s parents still have to cover their son’s medical expenses, they are unlikely to have the money necessary to cover the hospital’s legal bills, too. They are expected to declare bankruptcy.

Although there is no way to guarantee a positive outcome, it can be worthwhile to seek legal action against a negligent doctor or hospital.
